1. Introduction This Membership Agreement ("Agreement") outlines the terms and conditions for participation in The Spot Perth ("Studio"). By registering for any class, event, or activity through the Gymdesk platform, you acknowledge and agree to these terms.
2. Membership Terms

Membership is ongoing, billed monthly via Gymdesk, and will continue until canceled with a minimum of 2 days' written notice or at the studio.

Memberships are non-transferable and non-refundable, except under exceptional circumstances at the discretion of management.

Studio management reserves the right to adjust membership fees with 30 days' prior notice.

Membership Freeze:

Members may freeze their membership up to 3 times per calendar year (maximum 12 weeks total).

Freeze requests must be made via Reception at least 3 business days in advance.

Members will not have access to the studio during suspension unless purchasing a casual class pass.
3. Payment Terms

Payments are processed via Gymdesk direct debit from an approved credit card or bank account.

Members must ensure their payment method is up to date in Gymdesk.

If a payment fails, Gymdesk will notify the member. Membership will be suspended until payment is received.

Late Payments: If fees remain overdue for one month, the membership will be suspended, and access to classes will require a casual pass until dues are paid.

If unpaid fees result in debt collection, all outstanding amounts will be pursued, including the full payout of the monthly contract.

Fee Adjustments: The Spot Perth may adjust fees with 30 days' notice. Continued use after this period constitutes acceptance of the new rates.
4. Class Attendance & Cancellations

No-show fees: If a member fails to attend a booked class without canceling at least 8 hours in advance, the full class fee will be charged.

Management reserves the right to cancel or refuse membership due to inappropriate conduct.
5. Studio Use & Conduct

Members must share facilities with others and respect class participants who have priority access.

Proper attire and footwear are required at all times.
-
Members must follow staff instructions and use any equipment responsibly.
-
No consumption or possession of alcohol, intoxicating substances, or illicit drugs on the premises.

Any damage caused by a member to studio property must be compensated.
6. Liability Waiver & Assumption of Risk

Participation in studio activities involves inherent risks, including physical injury.

Members voluntarily assume all risks related to their participation.
-
The Spot Perth is not liable for injuries, except in cases of gross negligence.

Members must disclose any medical conditions that may affect their ability to participate.
-
In case of emergency, members consent to receive medical treatment, with all costs being their responsibility.
7. Privacy & Media Release

The Spot Perth collects personal data through Gymdesk for membership administration.
-
Members consent to video surveillance on studio premises for safety purposes.
-
Members grant permission for photos/videos taken during classes/events to be used for promotional purposes.
-
Personal data will not be shared with third parties except as required by law.
8. Emergency & Evacuation Procedures

In the event of an emergency, members must follow staff instructions to designated meeting points.

Emergency exits and safety procedures will be covered during member induction.
9. Force Majeure & COVID-19 Policies

If the studio must close due to unforeseen events (e.g., COVID-19 lockdowns), memberships may be suspended or credited for future use.

Members must comply with all health and safety measures in place.
10. Governing Law & Severability

This Agreement is governed by the laws of Western Australia.

If any provision is deemed unenforceable, the remaining terms remain valid.
